The 9th Circuit Court has ruled against insurers in cases between Nordstrom Inc. versus Chubb & Son Inc, case 54 F.3d 1424, and in Safeway Stores Inc. versus National Union Fire Insurance Co, case 64 F.3d 1282, holding the insurers liable for total costs.
